1. SUBJECT

These Terms and Conditions govern the relationship between Brasnar.bg (owned by ELLA DZZD) and the customers (hereinafter “Users”) of the online store when purchasing goods and services offered through the website.
They are compliant with:

• Bulgarian legislation, including the Consumer Protection Act, the Electronic Commerce Act, the Value Added Tax Act, and other applicable laws;

• European Union regulations and directives, including Directive 2011/83/EU on consumer rights, Regulation (EU) 2016/679 (GDPR), PSD2 for secure payments, and the EU ODR Regulation for online dispute resolution.

3. DEFINITIONS

• User: Any natural person using the website to place an order or obtain information.

• Merchant/Seller: Brasnar.bg / ELLA DZZD.

4. ACCEPTANCE OF THE TERMS

By accessing the Website and placing an order, the User confirms that they have read, understood, and agree to these Terms and Conditions.

5. ORDERS AND PAYMENT

Orders are placed exclusively through the Brasnar.bg website. An order is considered valid after confirmation by the Merchant.

Accepted payment methods:

1. Card payment via V-POS – Debit, credit, and business cards Visa, Mastercard, and bCard are accepted. Transactions are protected through MasterCard Identity Check and VISA Secure. No card data is stored by the Merchant. Refunds for payments made by card will be returned to the same card.

2. Bank transfer – Payments are made to the DSK Bank account specified at checkout.

3. Cash on delivery (COD) – Available for Bulgaria through Speedy and Econt couriers, who issue a fiscal receipt in compliance with Bulgarian tax legislation.

4. PayPal – Available for selected countries.

Currency:

• All prices are displayed in Bulgarian Lev (BGN) and Euro (EUR).

• From 01.01.2026, all prices will be displayed and charged in Euro, in accordance with the official adoption of the Euro in Bulgaria and EU monetary regulations.

6. DELIVERY

Couriers used: Speedy, Econt Express, DPD, DHL.

Delivery times:

• Bulgaria: 1–3 business days.

• EU countries: 5–10 business days.

Delivery costs:

• Free delivery to Speedy/Econt offices or lockers for all orders.

• For delivery to a personal address in Bulgaria: free for orders over BGN 100 / €50; for orders below this amount, the cost is calculated at checkout with our courier discounts applied automatically.

7. RETURNS AND COMPLAINTS

In accordance with the EU Consumer Rights Directive (2011/83/EU) and Bulgarian law, Users have the right to return goods within 14 days of receipt without providing a reason, except for cases listed below.

Conditions:

• Products must be unused, in their original commercial condition, with all labels and packaging intact.

• Return shipping costs are borne by the customer unless the return is due to a defect or incorrect delivery. In such cases, Brasnar.bg will cover the return shipping and send the correct item at its own expense.

Exceptions:

• No returns are accepted for goods made to the User’s specifications or clearly personalized (Art. 16(c) of Directive 2011/83/EU and Art. 57(3) of the Bulgarian Consumer Protection Act).

• No returns are accepted for cosmetics, perfumes, or hygiene-sensitive items once opened.

All returns must be submitted using the official form: Form: Returns and Complaints.

8. PERSONAL DATA PROTECTION

Brasnar.bg processes Users’ personal data in compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Bulgarian Personal Data Protection Act.

9. LIMITATION OF LIABILITY

Brasnar.bg is not responsible for:

• Delays or inability to deliver due to force majeure events.

• Minor variations in product color or design due to display differences.

10. CHANGES TO THE TERMS AND CONDITIONS

Brasnar.bg reserves the right to modify these Terms and Conditions at any time. Changes become effective from the date they are published on the Website.

11. APPLICABLE LAW AND DISPUTE RESOLUTION

These Terms are governed by Bulgarian law and the applicable laws of the European Union. Disputes shall be resolved:

1. By mutual agreement; or

2. By the competent Bulgarian court; or

3. Via the EU Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr.
